RESPONSE TO FINAL ACTION.

This response is to the Office action filed on March 3, 2009. After careful review the Applicant has determined the following.

AMENDMENT OF SERVICES - ACCEPTED

As suggested in the Office Action dated October 20, 2006, applicant adopts the following identification: Providing advertising, marketing and promotional services, namely, development of advertising campaigns for use on computers and related consulting.

REQUEST FOR INFORMATION - FINAL

The above suggested amendment is accurate.

SPECIMEN – FINAL

The previous substitute specimen should be acceptable to at least the extent of showing a dated first use of the term by companies who are predecessors in relation to applicant. Companies advertising "Search Engine Optimization" as a service, and are now in control by Modern Consulting Solutions / Applicant. The proposed mark is in the text of the "Advertisement" message, and should not be perceived to such a degree that it would not be seen as the birth of a services mark in the future.

Applicant hereby, submits another specimen in use to satisfy the reviewing attorneys requests, even though the other specimen is in actual use currently as well. Applicant submits "Search Engine Optimization," from ModernConsultingSolutions.com. The specimen is on the website from navigating to the services page. The substitute specimen can be seen under exhibit "A."
